Hereafter referred to as “The company”
Members of The Nannywage Ltd group of companies

1) All registered users of the The company website are required to accept these Terms & Conditions of use when using the website. The company may revise these terms and conditions at any time by updating this page.

2) The company acts in the capacity of an online contact site for private persons and business organisations wishing to find others to employ or be employed as a Nanny, Childminder, Babysitter or Carer. This service is not a recruitment agency as defined by the employment agencies act 1973 and therefore is not covered by the conduct of employment agencies and employment businesses regulation 2003.

3)  Potential employers and employees use this site to submit job vacancies and search for jobs, The company and its affiliates are under no obligation to monitor or review postings, confirm details, carry out any kind of background checks. For the avoidance of doubt The company does not make any representation or give any warranty for the accuracy or fitness for purpose of any information posted on the contact site by a user and we accept no liability whatsoever, in respect of any employment or actions resulting from the use of this contact site.

4) The site is designed to accommodate a diversity of interests and opinions. Users must conduct themselves in the appropriate manner. The site may not be used to post or transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable material of any kind, including, but not limited to., any material which encourages conduct that would harm The company’s business interests, constitute a criminal offence, violate rights of others, exploit children, or otherwise violate any applicable local, national or international law.

5) Use of the service is expressly limited to you. Your user details may not be transferred or shared with any other party and you may not resell or make any commercial or business use of the service. By submitting a job vacancy or employee CV you authorise The company to display the details on the contact website.

6) You acknowledge and agree that neither The company or its third party service providers endorse the content of any user and is not responsible or liable for any content, even though it could be unlawful, harassing, libellous, privacy invading, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable, or that it infringes or may infringe the intellectual property or other rights of another.

7) The User is responsible for the content of the vacancy or CV and will indemnify The company and its third party providers against any claim, loss, liability, expense and /or damage (“losses”) in connection herewith. The Company therefore reserves the right to pre-screen content and will have the right but not the obligation to refuse or remove any content that is to be posted on the contact site.

8) The service to potential employers is currently subject to a registration fee of £7.99 which entitles the user to display their job vacancy on the site for a period of two calendar months. After which time the job vacancy will be automatically deleted.
The company and its affiliates do not guarantee that the potential employer user will receive any responses to the displayed job vacancy. Any responses will be automatically forwarded to the potential employer user. It is the responsibility of the potential employer user to verify the content of any such responses. In particular, but without limitation , for vacancies the potential employer user is responsible for verifying the applicant’s identity, eligibility to work, experience, training, qualifications and authorisations required by the potential employer user , by law or by any relevant professional body for the vacancy.

9) The potential employer user will in their posted job vacancy provide sufficient details about themselves and details of the vacancy including, but not necessarily all of the following, the nature of the role, the type of work to be performed, the start date, the likely duration, the hours of work, the location, the salary, the payment frequency, holiday entitlements, benefits, job location and termination details.

10) The service to potential job seekers is free, you may post your vacancy on the site and after one month the details are automatically deleted. After which time you may post your details again if required. The company will not allow multiple entries to show at one time from the same job seeker. The potential job seeker user shall provide sufficient accurate details about themselves to enable a potential employer user to determine if they wish to contact the job seeker.

11) The company automatically forwards first response details to the users after which all and any subsequent dealings between the employer / employee are the responsibility of the users and The company and its affiliates accept no liability whatsoever therewith and the users agree to indemnify The company against any losses in connection therewith.

12) The user will comply with both the provisions of the Data Protection Act 1998 in relation to all applicants details and with all anti-discrimination legislation, including and not limited to the Sex Discrimination act 1975, The Race Relations Act 1976, The disability Discrimination Act 1995 and Tag Heuer Replica Uhren the Employment Equality (Age) Regulations 2006. The User will not post any vacancy or CV that directly or indirectly promoters age, sex or disability discrimination. The User will indemnify The company and its third party providers against any losses in connection herewith.

13) The potential employer user will not post a vacancy where the safety or health of an applicant maybe at risk either by the nature of the work performed or hazardous location. The potential employer user accepts responsibility for any detriment which they may suffer or incur in respect of the engagement of an applicant and shall hold The company harmless against any losses in connection therewith.

14) Using the site requires the potential employer user to act in “good faith” and post authentic impartial and unique jobs of reasonable quality, which provide adequate and accurate job details. Likewise the contact site and potential employer expect a job seeker to act with the same propriety.

15) The users agree that by not adhering to the terms and conditions of the service can result in the user’s access to the service being removed and account terminated at the sole discretion of The Company.

16) Users are prohibited from posting, publishing, distributing, uploading, disseminating, transmitting or linking to other web sites that contain material which:
is unlawful, defamatory, fraudulent, libellous, threatening, abusive, disruptive, sexually explicit, bigoted, harassing or obscene material. Would violate the privacy, proprietary or other rights of any person or entity; constitutes or promotes a criminal offence, or otherwise violate any national or international laws, contain corrupt files, viruses, Trojan horses, worms, time bombs or any other harmful contaminating or destructive features, contain contests, pyramid schemes, chain letters, junk mail, spamming or flaming. Advertise, promote, market, solicit orders for or offer to buy, sell, lease or license, products, goods and services. Use of the site for advertising of a commercial product or service is prohibited. You are prohibited from stalking or harassing others, creating a false identity or impersonating another person. From Harvesting, aggregating, mining, copying or otherwise collecting information about others, including but not limited to names, e-mail addresses, passwords, usage information without their consent.

17) If the user is an employment agency they will state their business by selecting agent in the CV submit sections and if an employment agency or employment business as defined by the Conduct of Employment Agencies and Business Regulations 2003 will comply with the provisions of the regulations and The Employment Agencies act 1973 in relation to all vacancies posted in the site and indemnify The company against any losses in connection therewith.

18) The company;
Cannot be held responsible for any losses,which may occur for the use or the inability to use the site.
Reserves the right to change the service charge. Cannot guarantee that the site will operate continuously without interruptions or be error free. Will accept no liability for the unavailability of the site at anytime.
Do not accept liability for loss of data caused by or to your computer system. We reserve the right to refuse service and make no representations in relation to any other web site which you may access through our site.

19) The company is only a recruitment service which allows individuals and organisations to post job opportunities and job seekers to post their CV. It does not censor, screen or have any way of independently checking the propriety of any listing. It is not involved in the dealings between employers and job seekers and as a result has no control over the accuracy, security, safety or legality of the vacancies or CV’s posted.
The company cannot therefore be held responsible for any resulting loss. Each user agrees that they use the sites at their own risk. The company cannot accept any responsibility either in contract, tort or otherwise for any direct, indirect consequential loss resulting from the use or the inability to use the service offered on the sites.

20) Prospective employers will have to pre pay the registration fee prior to their listing being accepted

21) If for any reason a listing is rejected the company will e-mail the employer/ job seeker to explain why the listing has been rejected.

22) The company requests that employers and job seekers in the first instance of contact via the site take every precaution when arranging a first meeting. The company cannot be held responsible for any costs that maybe incurred in arranging and travelling to a first meeting. After the initial contact via the site all subsequent meetings are arranged by the employer/ employee independently of the contact site.

23) These terms and conditions apply to users of the NannyEmployment Ltd & NannySharing Ltd sites and are completely separate from the terms and conditions applied when a user is employing the services of the payroll provider Nannywage Ltd & NannyPAYE Ltd.
Nannywage Ltd & NannyPAYE Ltd accept no responsibility for any consequences arising from the use of the contact sites as named at the beginning of the terms & conditions.
